Separation of Powers and Checks and Balances between the Executive and Judicial Branch - Term Paper Example It will be argued that while there are some limitations in the Executive/Judiciary relation, these limitations are also anticipated and addressed by further checks and balances. The roots of the balance of powers, lies with the American father's concern with factionalism. The Federalist papers, which numbered eighty-five, were written as theoretical defense's of the amendments to the Constitution, and they represent the justification for the notion of a 'balance of powers'. Federalist paper number ten specifically deals with the question of "factions", and was written by James Madison (Epstein 102). The most concise definition of a faction, might be phrased as a group with a central and discernible purpose, who are perceived to threaten the structures and powers of that which is protected or enshrined in the Constitution. In particular, the largest threat is articulated in terms of the potential dangers of those who advocate the "abolition of debts, for an equal division of property, or for any other improper or wicked project" [Boller 71], which is what he describes as the "most common and durable source" of factions [Boller 69]. Because Madison thinks liberty ought to be protected, and because he claims that dissension is "sown in the nature of man" [Boller 69]-- that is, people who are contrary will always exist, Madison advocates that one cannot remove the "causes", but instead one can only "control the effects" [Boller 70]. That is, if the causes are liberty and one does not want to remove liberty, then, one cannot control the causes. And, if dissension or difference is natural in humans, and one cannot remove an aspect of human nature, then, one cannot in this sense remove this causal aspect either. By a Republic as opposed to a democracy, Madison simply implies that representatives of the people as opposed to the people themselves are those who control the political spectrum. And, as representatives he claims that these figures will (in theory) be those who embody "wisdom", "patriotism", and a "love of justice" [Boller 70]. The American form of government is that of a ââ¬Ërepublicââ¬â¢, and it is the principal means by which the constitutional fathers thought that single factions could be challenged. This is marked by a number of variables which are written into the American Constitution which ensures the ââ¬ËBalance of Powersââ¬â¢. In brief, the balance is broken down into the ââ¬Ëexecutiveââ¬â¢, ââ¬Ëlegislativeââ¬â¢ and ââ¬Ëjudicialââ¬â¢ branches [Woll 4]. And, there is a balance between these branches with respect to passing or accepting legislative bills. In the United States, the President and every member of both houses is elected for a fixed term: the President for four years, the senators for six (one-third retiring every two years), the members of the House of Representatives for two [Schmidt, Shelley Bards and Ford 68]. The only way to get rid of a president before the end of the four-year te rm is to impeach him (her), which is very hard to do, and has never been done and only twice even attempted. Ministers often preached and delivered sermons to ââ¬Å"three different audiencesâ⬠, even through one service, as there were those who felt that they were assured of heavenly salvation, those that felt that they could receive it if they humbled themselves to God and His will a little more, and those that believed that they were never going to see heaven, no matter what their thoughts and deeds were (Reis 15). Goodman Brown obviously believes himself to be in the first category, most likely through living a life free of sin and wicked dee ds, and having been in constant prayer and humble service to the Lord. When Goodman Brown is first joined by the Devil on his walk, he boasts to him about how his faith is strong, and that he will never lose it. He states, ââ¬Å"We have been a race of honest men and good Christians since the days of the martyrsâ⬠¦we are a people of prayer, and good works to boot, and abide no such wickedness.â⬠Yet, as he walks on, it becomes clear that his faith is not as strong as he thought it was. He sees that others in his village have been consorting with the Devil, including Goody Cloyse, who taught him his catechism (religious studies) as a child, and the minister from the town church. The climax comes when Goodman Brown thinks that his wife is also in league with the Devil, causing him to lose his faith in his fellow man and his wife. Much of this is due to the fact that while Puritans held close the doctrine of grace, they held even closer the doctrine of depravity, and believed, without question, that humanity existed in a state of corruption due to ââ¬Å"original sinâ⬠, and only those in a state of grace, or those that were considered the ââ¬Å"electâ⬠, would go to heaven with the Lord; the rest, ultimately, were doomed to an eternity of Hell (Fischer 23). There is no fundamental reality of the issue: it relies upon the degree to which a woman views herself as a liberated entity rather than societyââ¬â¢s object of denigration. Hyvrard (1990) remarked that whatever we see, such as other individuals, is made an ââ¬Ëobjectââ¬â¢ of our scrutiny and is stereotyped by us. De Beauvoir adopts this argument and relates it to menââ¬â¢s view of women. The core idea of ââ¬Ëwomanââ¬â¢, as argued by de Beauvoir (1997), is a masculine notion: the f emale is constantly the ââ¬Ëotherââ¬â¢ because the man is the ââ¬Ëseerââ¬â¢ (Alison 2005, 81): ââ¬Ëhe is subject and she the objectââ¬âthe ââ¬Ëmeaningââ¬â¢ of what it is to be a woman is given by menââ¬â¢ (ibid, p. 81). In the aforementioned novels, which will be the sources of the analysis of feminist themes in French literature, it was argued that it is not the natural position of women as such that comprises a disadvantage: it is how a woman sees this situation which makes it negative or positive. As shown in Al-Joundiââ¬â¢s novel, none of the unique experiences of women, such as the menstruation, pregnancy, have a significance in themselves; however, in an oppressive or antagonistic society they can acquire an essence of being a disadvantage and a weakness, as women decide to accept the stereotypes of a patriarchal society. De Beauvoir (1997) stresses that pre-adolescent girls and boys are actually not especially different: they ââ¬Å"have the sam e interests and the same pleasuresâ⬠(ibid, p. 295).This essay will review the feminist themes of the French novels mentioned above, with an emphasis on the works of De Beauvoir and Wollstonecraft. The Oppression of the Female Body De Beauvoir (1997) claims that as the development of a femaleââ¬â¢s body takes place, each new phase is endured and separates her ever more roughly from the opposite sex. As the female body develops, society responds in a more and more aggressive and threatening way. Wollstonecraft (2004) refers to the dynamic of ââ¬Ëbecomingââ¬â¢, which is the mechanism whereby an individual understands oneself as a bodily, and sexual being open to the scrutiny of others. This does not have to be detrimental, but inopportunely, girls are frequently compelled to ââ¬Ëbecomeââ¬â¢ against their free will (De Beauvoir 1997): The young girl feels that her body is getting away from her... on the street men follow her with their eyes and comment on her anatom y. She would like to be invisible; it frightens her to become flesh and to show flesh (ibid, p. 333).
